Data & Media Submission Terms and Conditions

By submitting your textual and/or audiovisual data (hereinafter the "Content") to California Bird Atlas (CBA) using the CBA Data Submission Form, you retain the copyright to this Content, and you thereby grant to CBA a non-exclusive, worldwide, royalty-free and perpetual license, in all media (print, electronic, or other), to use, distribute, sublicense (see below), reproduce, modify, adapt, and publicly display the Content for any purposes that further the research and educational mission of CBA. These purposes may include (without limitation) scientific research, display on CBA websites, promotional uses, and inclusion in CBA multimedia content and products. We retain the right to sublicense the Content for research use, including to the Cornell Lab of Ornithology (eBird, Macaulay Library) and University of California Los Angeles, but we will not sublicense the Content to any third party for commercial use without your permission. Whenever CBA uses your media, you will be attributed.

You warrant that the Content is either owned by you, or in the public domain. You agree that you will hold CBA harmless from any claims of Content ownership or infringement by any other person or entity. You agree that you are solely responsible for protecting the Content from infringement by a third party; CBA is not responsible for pursuing such claims on your behalf. CBA reserves the right to use/not use any submitted Content as deemed appropriate by CBA in its sole discretion.

You represent that you are 18 years old or older. If you are between the age of 13 and 17, you may submit media with the consent of a parent or guardian. For Young Birders: We're thrilled you would like to contribute! If you are between the ages of 13–17, please ask your parent or guardian to contact us before submitting. For Parents and Guardians: To grant your 13–17 year old permission to submit data, please email info@californiabirdatlas.org with the following: "I grant my child (insert name) permission to upload content to California Bird Atlas. I agree to the terms and conditions for uploading content."
